1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and HAPPY HAIR SALON LLC ("Company," "we," "our," or "us"). By downloading, installing, accessing, or using any of our mobile applications (including Smart Weather Forecast and Vitals Monitor �?BP & Blood Lipids) or our website (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services and must uninstall any Apps.

2. Eligibility

You represent that you are at least thirteen (13) years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. License Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use our Apps on a compatible device that you own or control, solely for personal, non-commercial purposes.

You agree not to, and will not permit any third party to:

Copy, modify, adapt, translate, or create derivative works of the Apps or website content;
Reverse engineer, decompile, disassemble, or attempt to derive source code except where expressly permitted by applicable law;
Rent, lease, lend, sell, sublicense, or commercially exploit the Services;
Remove proprietary notices or circumvent security or access controls;
Use the Services for unlawful, fraudulent, harassing, or harmful purposes;
Interfere with or disrupt servers, networks, or other users' enjoyment of the Services.

4. Intellectual Property

All rights, title, and interest in and to the Services, including software, code, trademarks, logos, trade dress, and content, are owned by HAPPY HAIR SALON LLC or its licensors and are protected by United States and international intellectual property laws. No rights are granted except as expressly set forth herein.

5. Third-Party Services

The Services may link to or integrate third-party services (including Google Play, advertising networks, and analytics providers). Your use of third-party services is governed by their terms and policies. We are not responsible for third-party content, availability, or practices.

6. Subscriptions and In-App Purchases

If an App offers paid features or subscriptions, purchases are processed through Google Play (or other authorized platforms). Refunds and billing disputes are handled according to the platform's policies. We do not store full payment card details.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT RESULTS OBTAINED FROM USE WILL MEET YOUR REQUIREMENTS.

Utility-specific notice: Weather forecasts, health logging, blood pressure or lipid tracking, and similar features are provided for general informational and organizational purposes only. They are not medical, meteorological, or professional advice. Always consult qualified professionals for health or safety decisions. Do not rely on the Apps as a substitute for professional diagnosis or emergency services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAPPY HAIR SALON LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE RELEVANT APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50.00).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless HAPPY HAIR SALON LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, the license granted herein ends immediately. Sections that by nature should survive termination shall survive.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. You agree that exclusive jurisdiction and venue for disputes arising under these Terms shall lie in the state and federal courts located in California, and you waive any objection to such jurisdiction.

12. Changes to Terms

We may modify these Terms at any time by posting an updated version on this page with a revised "Last updated" date. Material changes may also be communicated through the App or website where appropriate. Your continued use after the effective date constitutes acceptance of the revised Terms.

13. Severability and Entire Agreement

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
